1. ACCEPTANCE OF TERMS

3. RESEARCH USE ONLY — RESTRICTION OF USE

3.1 ALL PRODUCTS SOLD BY LIVING WATERS BIOWORX LLC ARE STRICTLY FOR IN VITRO LABORATORY AND SCIENTIFIC RESEARCH PURPOSES ONLY.

3.2 Our products are NOT intended for and must NOT be used for:

• Human consumption or ingestion in any form

• Animal consumption or veterinary use

• Therapeutic, clinical, or medical purposes

• Diagnostic procedures of any kind

• Any in vivo applications

• Self-administration or administration to any other person or animal

• Resale to unlicensed or unauthorized parties

3.3 None of our products have been evaluated or approved by the U.S. Food and Drug Administration (FDA) for human or animal use. Our products are not drugs, supplements, or medical devices.

3.4 By purchasing from us, you assume full legal responsibility for how you use or misuse the products. The Company shall bear no liability for any misuse, unauthorized use, or improper handling of purchased products.

4. INTELLECTUAL PROPERTY

4.1 All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, blog articles, and software, is the property of Living Waters BioworX LLC or its content suppliers and is protected by applicable intellectual property laws.

4.3 The Living Waters BioworX name, logo (water drop / DNA helix / cross design), and proprietary stack names including 'Wolverine,' 'KLOW,' and 'GLOW' are trademarks of Living Waters BioworX LLC. Unauthorized use of any trademark is strictly prohibited.

5. PRODUCTS, PRICING & AVAILABILITY

5.1 We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice.

5.2 All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time your order is confirmed.

5.3 We reserve the right to limit the quantities of any products we sell. Product descriptions, including dosage information, are provided for research reference only and do not constitute medical advice.

5.4 Despite our best efforts, products on our Site may occasionally be mispriced. We reserve the right to cancel any order placed for a product listed at an incorrect price.

6. ORDERS & PAYMENT

6.1 By placing an order, you represent that all information you provide is accurate, current, and complete, and that you are authorized to use the payment method provided.

6.2 All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed for non-research purposes.

6.3 Payment is due in full at the time of order placement. We accept payment methods as displayed on the Site or as communicated at the time of sale.

6.4 You agree not to engage in any fraudulent transactions, chargebacks, or disputes without first contacting us to resolve the issue directly.

7. SHIPPING & DELIVERY

7.1 We ship to all U.S. states and select international destinations. It is the buyer's responsibility to ensure that receipt of ordered products is lawful in the destination jurisdiction.

7.2 Risk of loss and title for products pass to you upon delivery to the shipping carrier.

7.3 We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control. Estimated delivery times are not guaranteed.

7.4 All peptide products are shipped using cold-chain packaging to preserve compound integrity. We are not responsible for product degradation resulting from improper storage after delivery.

8. RETURNS, REFUNDS & CLAIMS

8.1 Due to the nature of research compounds, all sales are final. Returns are accepted only for products that are demonstrably defective or incorrectly shipped.

8.2 All claims for defective or incorrect products must be submitted in writing to jmarx@livingwatersbioworx.com within 5 business days of receipt, with photographic documentation.

8.3 Approved returns must be shipped in original, unopened packaging. The Company will issue a replacement or store credit at its sole discretion.

8.4 We reserve the right to deny any return or refund claim that does not meet these requirements.

9. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE,' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, LIVING WATERS BIOWORX LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE 90-DAY PERIOD PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Living Waters BioworX LLC, its members, officers, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of any product purchased from us

• Your use of the Site

• Any use of products for human or animal consumption or therapeutic purposes

• Your violation of any law or the rights of any third party

• Any content you submit or transmit through the Site

12. USER CONDUCT

16.3 YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16.4 Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

17. SEVERABILITY & WAIVER

17.1 If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17.2 Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Research Use Acknowledgment, constitute the entire agreement between you and Living Waters BioworX LLC with respect to the Site and products, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
